The National Sand, Stone & Gravel Association, in conjunction with the Georgia Construction Aggregates Association, is asking the U.S. Court of Appeals for the 11th Circuit to review OSHA's crystaline silica rule. The April 4 petition is the latest in a series of petitions from other industry groups and labor unions that have been filed in various appellate circuits. The Judicial Panel on Multi-District Litigation will decide by lottery in the coming weeks which circuit will be the venue for the consolidated litigation.
